Terms of Use
Effective September 2026
These Terms of Use govern access to and use of the Capline compliance portal (the “Portal”), provided by Bowery Consulting Labs (“BCL,” “we,” “us”). By accessing or using the Portal, you agree to these Terms. If you do not agree, please do not use the Portal.
Access and accounts
The Portal is provided to authorized clients of BCL and their designated users. Accounts are granted, and may be reviewed, suspended or revoked, at our discretion. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us promptly if you believe your account has been accessed without authorization.
Acceptable use
You agree to use the Portal only for its intended purpose, and not to:
- attempt to access buildings, reports or accounts that are not yours;
- share your credentials with, or grant access to, unauthorized persons;
- interfere with, disrupt or attempt to circumvent the security of the Portal; or
- use the Portal in any way that violates applicable law.
Reports and content
Inspection reports and other content made available through the Portal are provided for the use of the named client and building owner in connection with their Local Law 126 compliance. Reports reflect conditions observed as of the inspection date and are provided for compliance and informational purposes. They do not replace or discharge a building owner's own legal obligations under Local Law 126 or other applicable law. Reports and Portal content remain the property of BCL and/or the applicable client and may not be redistributed to third parties for unrelated purposes without authorization.
Availability
We work to keep the Portal available and accurate, but it is provided on an “as is” and “as available” basis. We may modify, suspend or discontinue features from time to time, and the Portal may occasionally be unavailable for maintenance or reasons beyond our control.
Limitation of liability
To the fullest extent permitted by law, BCL will not be liable for any indirect, incidental or consequential damages arising out of your use of, or inability to use, the Portal. Nothing in these Terms limits any professional obligations BCL owes under a separate written services agreement with a client, which governs the underlying inspection services.
